1. Object and acceptance
These Terms of Use govern access to and use of the Red Activa México (“RAM”) digital platform, available at www.redactivamexico.net as well as static pages and experiences integrated within the ecosystem. By accessing, browsing, registering, or using RAM, you acknowledge that you have read and fully accepted these Terms. If you do not agree, you must refrain from using the site and services.
2. Definitions
Platform / RAM: RAM-operated technology ecosystem, including social modules, directories, content, and digital services.
Social network: a thematic community created within RAM.
Moderator: Authorized RAM personnel designated to manage content and compliance in a network or section.
User: a person who creates an account and uses the available features.
Visitor: a person who browses without registering.
Client (Business/Place/Page): entity whose digital presence is created, published or managed on RAM as part of services, agreements or plans.
Content: information, texts, images, audio, video, brands, descriptions, reviews, comments and any material published on RAM.
Ecosystem Services: modules such as RAM Social Network, RAM Maps, RAM Music, RAM IPTV, RAM Plaza, Skyverse and other spaces.
3. Scope of the ecosystem and complementary terms
RAM may integrate or link modules/services that operate within the main domain or through subdomains/external services (e.g., marketplace/e-commerce or travel programs). These Terms apply to the general use of RAM. Some modules may have supplementary policies or terms (e.g., payments, returns, reservations, memberships, shipping) that will prevail for that module in case of conflict.
4. Access to the platform
RAM may enable freely accessible features (for Visitors) and restricted features (for Users). RAM reserves the right to modify, suspend, or limit access, in whole or in part, for operational, security, maintenance, or force majeure reasons.
5. Registration, accounts and security
Registration is personal and non-transferable.
The User agrees to provide truthful information and keep it updated.
The User is responsible for the confidentiality of their credentials and all activity from their account.
RAM can implement security measures (verification, limitations, detection of suspicious activity) to protect the platform.
6. Multi-social network structure and roles
6.1 Social networks and moderation. Each social network may have Moderator(s) responsible for managing content and compliance.
6.2 RAM-managed publication. The creation, registration, and updating of Businesses/Places/Pages is generally performed by authorized RAM personnel based on customer information.
6.3 Transfer of Control. In exceptional cases, RAM may delegate administration to the Client exclusively through a specific agreement/contract. Until such an agreement/contract exists, administration remains with RAM.
6.4 Users and Visitors. They can explore and interact according to enabled features. RAM may activate/deactivate features at any time.
7. Content, licenses and community rules
7.1 Editorial Management. RAM defines criteria for the organization, format, labeling, and display of content, prioritizing experience, quality, and security.
7.2 User-Submitted Content License. By publishing content on RAM, the User grants RAM a non-exclusive, worldwide, royalty-free, and sublicensable license to host, reproduce, communicate, adapt (in technical formats), and display said content within the ecosystem for RAM's operational, distribution, and promotional purposes. The User retains their rights; RAM does not acquire ownership of the User's content.
7.3 Client Content. The Client guarantees the accuracy and rights to use texts, trademarks, logos, and images. The Client grants RAM a non-exclusive license to publish and promote its presence during the relationship.
7.4 Prohibitions. It is prohibited to publish, solicit or distribute content that:
Infringes copyright, trademark, image or privacy rights.
Whether it is unlawful, defamatory, discriminatory, hateful, violent, or promotes harm.
Include sexual exploitation, sexually explicit content, or abuse (especially of minors).
Contains personal data of third parties without consent.
Promote fraud, phishing, scams, deceptive schemes, or impersonation.
Include malware, malicious links, or spam.
Look for artificially manipulating metrics (bots/unauthorized automation).
7.5 Moderation. RAM and Moderators may reject, edit, restrict, delist or remove content; limit functions or suspend accounts when necessary for compliance, security or quality.
7.6 Reports. Users/Visitors can report allegedly infringing content through mechanisms available on the platform.
8. Pages, Places and Businesses
8.1 Truthfulness and licenses. The Client guarantees that the content delivered is truthful and has rights/authorizations.
8.2 Upgrades and cancellations. The Client may request changes or cancellations in accordance with the terms of the contracted service; RAM will have a reasonable time to process them.
8.3 Reviews and opinions. If reviews are enabled, they represent their author. RAM may moderate reviews that violate rules (fraud, insults, spam, personal data).
9. Services, contracting and payments (for Clients)
9.1 Contracting. Digital presence and promotion of Businesses/Places/Pages may be a paid service. The conditions will be detailed in the proposal/order/contract.
9.2 Billing and collections. Non-compliance may result in service suspension.
9.3 Changes to plans and rates. RAM may update rates with reasonable notice.
9.4 Refunds. Unless expressly provided by law or contract, payments made are non-refundable. See the Refund Policy for applicable cases.
10. Paid features, subscriptions and digital content
RAM may offer paid features (memberships, upgrades, professional features, bundles, monetization, or digital services). In those cases:

11. Marketplace / E-commerce (RAM Plaza / RAM Store)
RAM can integrate marketplace/e-commerce experiences with product/service purchases. These experiences may have specific policies regarding payments, shipping, returns, and refunds. When marketplace-specific policies exist, they will apply to those transactions.
12. Skyverse (Travel) and third-party services
RAM may offer or link to travel/membership programs (Skyverse) connected to third-party inventory and services. These services are subject to the provider's terms. RAM does not control availability, pricing, changes, or cancellations by third parties; it may offer support according to the scope of the program.
13. Third-party integrations and services
RAM may integrate third-party services (maps/geolocation, analytics, payments, reservations, security). The use of these services may also be governed by the provider's terms. RAM does not guarantee the availability or terms of third-party services.
14. Intellectual property and permitted use
14.1 RAM Rights. Platform, code, design, databases, trademarks, and associated elements are protected. Unauthorized use, copying, reverse engineering, scraping, bulk extraction, or use exceeding normal access is prohibited.
14.2 Third-party rights. Customer trademarks/materials are published with permission and remain under their ownership.
15. Conduct and permitted use
You agree to comply with the law and these Terms, and not to:
To interfere with technical operation.
To breach security or gain unauthorized access.
To supplant identities.
Collecting data without a legal basis.
Using unauthorized bots/automation.
16. Availability, maintenance and changes
RAM makes reasonable efforts to maintain availability, but does not guarantee uninterrupted service. It may perform maintenance and modify/remove features for security or improvement purposes.
17. Liability and Exemptions
17.1 Information and Transactions. The accuracy of information on Businesses/Places/Pages is the responsibility of their owners. RAM is not responsible for agreements made outside the platform.
17.2 Damages. To the maximum extent permitted by law, RAM will not be liable for indirect damages, loss of profits or loss of data.
17.3 Limitation of liability. Where applicable, total liability shall not exceed the amount paid by the Client to RAM in the three (3) months prior to the event.
18. Compensation
The User and/or Client shall indemnify RAM against third-party claims for: misuse, infringement of intellectual property or false/illegal information provided.
19. Suspension and Termination
RAM may suspend or terminate access for non-compliance. RAM may retain minimal records for legal or security reasons for applicable periods.
20. Data protection
Data processing is governed by the current Privacy Policy. In case of discrepancy, the Data Privacy Policy prevails.
21. Modifications
RAM may update these Terms. They become effective upon posting. Continued use constitutes acceptance.
22. Applicable law and jurisdiction
These Terms are governed by the laws of Mexico. The parties submit to the jurisdiction of the competent courts in Mexico, except where mandatory rules apply.
23. Partial nullity
If one provision is invalid, the others remain in force.
